1. Introduction

Équipe Lefrançois is a team of real estate brokers operating within Royal LePage Tendance, a real estate agency. This policy describes our practices regarding personal information collected through equipelefrancois.ca, in connection with our real estate brokerage activities in Montreal and the greater metropolitan area.

We comply with the Quebec laws applicable to the protection of personal information in the private sector, notably the Act respecting the protection of personal information in the private sector, as amended by the Act to modernize legislative provisions as regards the protection of personal information (commonly known as "Law 25"). This policy is not intended to present the site as primarily subject to the European General Data Protection Regulation (GDPR), which does not apply to our activities.

2. Who processes your personal information

4. Types of information we collect

We only collect the information actually requested by the site's active forms and features, namely:

• your first and last name;
• your email address;
• your phone number (when you provide it);
• a property address (yours, in a valuation request, or one you are interested in);
• property type and search criteria (areas of interest, approximate budget);
• your real estate project (buying, selling, valuation) and approximate timeline;
• the content of your messages and requests;
• your consent to be contacted and, where applicable, your separate consent to receive marketing communications;
• technical and browsing data (IP address, browser type, device type, operating system, pages visited, traffic source, UTM parameters), collected only if you consent to analytics or marketing cookies as described in our Cookie Policy.

5. Why we collect this information

We use your personal information only for the following purposes:

• responding to your request (valuation, buying, selling, general contact, information about a property);
• following up with you on your real estate project;
• sending you, if you have separately consented, news and real estate communications from the team;
• improving the site and understanding how it is used, when you have consented to analytics;
• measuring the effectiveness of our advertising campaigns, when you have consented to marketing;
• meeting our legal and regulatory obligations, including those applicable to real estate brokerage.

6. Online forms

Every form on the site (valuation, selling, buying, contact, property information request) displays a notice explaining why the information is requested and links to this policy. Information collected through a form is never used for a purpose other than the one stated at the time of collection.

7. Property valuation requests

The information provided as part of a valuation request (address, property characteristics, contact details) is used only to review and respond to your request and follow up with you. A valuation request never automatically results in a sign-up to our marketing communications — that sign-up requires your separate, optional consent.

8. Communications with buyers and sellers

When you contact us as a prospective buyer or seller, your information is used to carry out the exchanges necessary to your real estate project (viewings, offers, file follow-up) with the relevant team broker(s).

9. Marketing communications and newsletter

We never automatically sign you up for a newsletter or marketing communications simply because you submitted a service request form. Where a voluntary sign-up is offered, it takes the form of a separate, unchecked checkbox: "I agree to receive real estate news, insights and communications from Équipe Lefrançois by email. I may unsubscribe at any time."

Every marketing email includes an unsubscribe mechanism, in accordance with Canada's Anti-Spam Legislation (CASL). We keep proof of consent given (contact identifier, email, date and time, source form or page, language, version of the consent text, consent status, and any later withdrawal), so that we can demonstrate that consent if needed.

10. Cookies and similar technologies

The site uses cookies and similar technologies. The categories used, how to accept, reject or change your consent, and the preference-management mechanism are described in detail in our Cookie Policy.

11. Analytics

With your consent, we may use analytics tools to understand how the site is used (pages visited, navigation paths, traffic sources) and to improve its content. These tools are never activated before your consent is obtained, as described in our Cookie Policy.

12. Digital advertising

With your consent, we may use advertising tools to measure the effectiveness of our campaigns and, where applicable, show you relevant ads on other sites. No non-essential advertising tag fires before your consent.

13. Google Analytics

When enabled, Google Analytics (GA4) helps us measure site traffic and usage in aggregate. We never send Google Analytics your name, email, phone number, full address or any other identifiable personal information — only browsing data and non-personal parameters are sent, and only after your consent to analytics.

14. Google Ads

When active, our Google Ads campaigns may use conversion tracking and remarketing tools, only after your consent to marketing. A lead form hosted directly by Google remains subject to Google's own terms and privacy policies.

15. YouTube

The team publishes market analyses on its YouTube channel. When videos are embedded directly on the site rather than linked out, a privacy-enhancing approach ("no-cookie" mode, click-to-load) is used so that no YouTube cookie is set before you choose to interact with the video.

16. Meta (Facebook and Instagram)

The site includes links to the team's Facebook and Instagram pages. These links lead to third-party platforms governed by Meta's own privacy policies. Should a Meta pixel or conversion API ever be used on this site, this policy would be updated beforehand and its use would remain subject to your marketing consent.

17. Customer relationship management (CRM) system

The team forwards received requests to Bigin by Zoho, a customer relationship management (CRM) system, for structured follow-up on your file.

18. Email and messaging services

Your emails and requests pass through ZohoMail, the email service used by the team to respond to you and follow up.

19. Website hosting

The site is hosted by Hostinger.

20. Other third-party services

The site may rely on other third-party providers for functions such as interactive maps, appointment booking, or spam and abuse protection. Each such provider only receives the data strictly necessary for its function.

21. Disclosure of your information to third parties

We do not sell our users' personal information. Your information is only disclosed to the persons and providers mentioned in this policy, to the extent necessary to respond to your request, operate the site, or comply with a legal obligation.

22. Processing and hosting outside Quebec

Some technology providers used by the team — notably Hostinger (site hosting), ZohoMail (email) and Bigin by Zoho (CRM) — may process or store information outside Quebec. When this is the case, we take steps to ensure the provider offers protection deemed equivalent to that required under Quebec law, and we meet the privacy-impact-assessment obligations applicable to such transfers.

23. Retention and destruction of information

We keep your personal information for 90 days after it is collected, or for as long as necessary to meet our legal obligations if that period is longer. At the end of that period, information is securely destroyed or anonymized.

24. Security of your information

We apply reasonable security measures, appropriate to the sensitivity of the information collected, to protect it against loss, theft, or unauthorized access, use or disclosure. Every form submission on this site is encrypted (HTTPS).

25. Internal access to information

Only team members and authorized providers who need it to perform their duties have access to the information you share with us.

26. Your rights

Under applicable Quebec law, you have rights over your personal information, including the rights of access, rectification and consent withdrawal described below.

27. Handling privacy complaints

Any access, rectification or consent-withdrawal request, or any privacy complaint, may be submitted to the person responsible for the protection of personal information (section 3) or through our "Personal Information Request" page. We acknowledge your request and respond within the timelines set by law. If you are not satisfied with how your complaint was handled, you may contact the Commission d'accès à l'information du Québec.

This site may contain links to third-party sites (social media, Centris, property microsites, YouTube). This policy does not apply to those third-party sites, whose own privacy policies we encourage you to review.

29. Changes to this policy

We may update this policy to reflect changes in our practices or legal requirements. The date of the last update appears at the top of this page. Material changes will be announced prominently on the site.
